Probate is used when the decedent died with a will. The court reviews the will and may issue Letters Testamentary to the executor. Users should be ready to identify distributees, file the original will, provide the death certificate, and prepare probate notices, waivers, citations, or affidavits as needed.

A small estate, also called voluntary administration, may be available when the decedent had $50,000 or less in personal property. It does not authorize administration of real property such as a house, land, or condominium.
